NOTICE OF SHERIFF’S SALE

 

Under and by virtue of a Writ of Execution issued out of the District Court of the Seventh Judicial District of the State of Idaho, in and for the County of Bonneville, Case No. CV-18-1992, upon the 23rd day of January, 2019, Bayview Loan Servicing, LLC, A Delaware Limited Liability Company, Plaintiff, obtained a Judgment, Order of Sale and Decree of Foreclosure against The Estate of Geraldine Colvin aka Geraldine M. Colvin, Deceased, is indebted to the Plaintiff in the sum of $68,315.98, plus interest at 7.375%, and that all of the named Defendants shall be barred and foreclosed from all right, title, and interest in and to the below described property;

           

NOTICE IS HEREBY GIVEN That on the 6th day of August, 2019, at the hour of 1:00 o’clock p.m. of said day, at 605 N. Capital Idaho Falls, ID 83402 Bonneville County Courthouse Rotunda,  County of Bonneville, State of Idaho, I will sell at public auction to the highest and best bidder, for cash or certified funds in lawful money of the United States of America, all of the right, title and interest of said Defendant, Estate of Geraldine Colvin aka Geraldine M. Colvin, Deceased, in and to the following described real property, to satisfy the Plaintiff’s Judgment, with costs.  Said real property is particularly described as follows:

 

LOT 1 IN BLOCK 4 OF MOBILE HOME ESTATES SUBDIVISION, DIVISION NO. 1, TO THE CITY OF IDAHO FALLS, RECORDED JUNE 18, 1958, AS INSTRUMENT NO. 263540, ACCORDING TO THE OFFICIAL PLAT THEREOF, FILED IN OFFICIAL RECORDS OF BONNEVILLE COUNTY, IDAHO.

 

The above-described property is commonly known as 353 N Contor Ave, Idaho Falls, ID 83401.

 

The Sheriff, by Certificate of Sale, will transfer the right, title and interest of the judgment debtor in and to the property at the time the execution or attachment was levied. The Sheriff will also give possession but does not guarantee clear title nor continued possessory right to the purchaser. The Sheriff sells all property “as is”, “whereas”, and without any guarantee or warranty whatsoever.

           

All bidders must register with the Sheriff prior to the start of the sale and must have in their possession sufficient cash or a letter from their bank or financial institution guarantying the availability of funds. Payment by cash or certified funds is due by 3 PM on the day of the sale. Plaintiff has the right to submit a credit bid.

You are also notified that this parcel consists of less than twenty (20) acres and that Defendant, The Estate of Geraldine Colvin aka Geraldine M. Colvin, Deceased, and/or any junior lienholder may have the right to redeem the property sold hereunder for a period of six months in accordance with Idaho Code §11-401 et seq.
