            Under and by virtue of a Writ of Execution issued out of the District Court of the Seventh Judicial District of the State of Idaho, in and for the County of Bonneville, Case No. CV10-19-2091, on December 7, 2021, wherein Plaintiff, Bayview Loan Servicing, LLC, a Delaware Limited Liability Company, obtained an Amended Judgment, Order of Sale and Decree of Foreclosure against Estate of Karen Keating, Deceased; John/Jane Doe, Unknown Spouse of Karen Keating, Deceased; Unknown Heirs and Devisees of Karen Keating, Deceased; Christopher Keating aka Chris Keating aka and “Lucky” Keating”; Rovilla Guymon aka “Rover” Guymon; Jack Beardsley; Mark Beardsley; Joey Beardsley; JP Development, Inc. dba Acctcorp International; CBS Collections, Inc dba CBS Financial Services; Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust, Not In Its Individual Capacity But Solely In Its Capacity As Owner Trustee For Wf 19 Grantor Trust; John and Jane Does, I Through V, Occupants of the Subject Real Property; and also, The Unknown Owners of the Real Property that is subject of these proceedings, Including All Parties With an Interest in and/or Residing in Real Property, in the sum of $89,349.30, plus interest and costs, and that all of the named Defendants shall be barred and foreclosed from all right, title, and interest in and to the below described property;

            NOTICE IS HEREBY GIVEN that on the 8th day of February, 2022, at the hour of 1:00 P.M. on said day, at 605 N. Capital Ave, Idaho Falls, ID 83402, Courthouse Rotunda, County of Bonneville, State of Idaho, I will sell at public auction to the highest and best bidder, for cash or certified funds in lawful money of the United States of America, all of the right, title and interest of said Defendants, Estate of Karen Keating, Deceased; John/Jane Doe, Unknown Spouse of Karen Keating, Deceased; Unknown Heirs and Devisees of Karen Keating, Deceased; Christopher Keating aka Chris Keating aka and “Lucky” Keating”; Rovilla Guymon aka “Rover” Guymon; Jack Beardsley; Mark Beardsley; Joey Beardsley; JP Development, Inc. dba Acctcorp International; CBS Collections, Inc dba CBS Financial Services; Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust, Not In Its Individual Capacity But Solely In Its Capacity As Owner Trustee For Wf 19 Grantor Trust; John and Jane Does, I Through V, Occupants of the Subject Real Property; and also, The Unknown Owners of the Real Property that is subject of these proceedings, Including All Parties With an Interest in and/or Residing in Real Property, to satisfy the Plaintiff’s Judgment, with interest and costs.  Said real property is particularly described as follows:

A PARCEL OF LAND BEING ON THE NORTHWESTERLY SIDE OF THE CENTER LINE OF U.S. HIGHWAY NO. 20 PROJECT NO. F-6471 1311 HIGHWAY SURVEY AS SHOWN ON THE PLANS THEREOF NOW ON FILE IN THE OFFICE OF THE DEPARTMENT OF HIGHWAYS OF THE STATE OF IDAHO, AND BEING A PORTION OF LOTS 8, 9 AND 10, IN BLOCK 26 OF HIGHLAND PARK ADDITION, TO THE CITY OF IDAHO FALLS, ACCORDING TO THE OFFICIAL PLAT THEREOF, RECORDED MAY 16, 1892 IN OLD PLAT BOOK AT PAGE(S) 5, FILED IN OFFICIAL RECORDS OF BONNEVILLE COUNTY, IDAHO, AND DESCRIBED AS FOLLOWS, TO WIT:

 

BEGINNING AT THE NORTHWEST CORNER OF LOT 10, BLOCK 26, HIGHLAND PARK ADDITION, TO THE CITY OF IDAHO FALLS, COUNTY OF BONNEVILLE, STATE OF IDAHO; RUNNING THENCE SOUTHERLY ALONG THE WEST LINE OF LOTS 10, 9 AND 8, SAID BLOCK 26, A DISTANCE OF 75.0 FEET TO THE SOUTHWEST CORNER OF SAID LOT 8; THENCE EASTERLY ALONG THE SOUTH LINE OF LOT 8 A DISTANCE OF 71.87 FEET; THENCE NORTH 35°22'57" EAST 91.91 FEET TO THE NORTHEAST CORNER OF SAID LOT 10; THENCE WESTERLY ALONG THE NORTH LINE OF SAID LOT 10 A DISTANCE OF 125.0 FEET TO THE POINT OF BEGINNING

 

            The above-described property is commonly known as: 1333 Jefferson Ave, Idaho Falls, ID 83402.

            You are also notified that this parcel consists of less than twenty (20) acres and that Defendants, Estate of Karen Keating, Deceased; John/Jane Doe, Unknown Spouse of Karen Keating, Deceased; Unknown Heirs and Devisees of Karen Keating, Deceased; Christopher Keating aka Chris Keating aka and “Lucky” Keating”; Rovilla Guymon aka “Rover” Guymon; Jack Beardsley; Mark Beardsley; Joey Beardsley; JP Development, Inc. dba Acctcorp International; CBS Collections, Inc dba CBS Financial Services; Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust, Not In Its Individual Capacity But Solely In Its Capacity As Owner Trustee For Wf 19 Grantor Trust; John and Jane Does, I Through V, Occupants of the Subject Real Property; and also, The Unknown Owners of the Real Property that is subject of these proceedings, Including All Parties With an Interest in and/or Residing in Real Property, and/or any junior lienholder may have the right to redeem the property sold hereunder for a period of six months in accordance with Idaho Code §11-401 et seq.

            The Sheriff, by Certificate of Sale, will transfer the right, title and interest of the judgment debtor in and to the property at the time the execution or attachment was levied. The Sheriff will also give possession but does not guarantee clear title nor continued possessory right to the purchaser. The sheriff sells all property “as is”, “whereas” and without any guarantee or warranty whatsoever.

            All bidders must register with the Sheriff prior to the start of the sale and must have in their possession sufficient cash or a letter from their bank or financial institution guarantying the availability of funds. Payment by cash or certified funds is due by 3 p.m. on the day of the sale.
